Terms of Service

These Terms of Service ("Terms") govern access to and use of ResetProof, a software product operated by PCB Creatives LLC ("we," "us," or "our"). ResetProof is offered to businesses — hotels, resorts, and short-term-rental operators ("Customer," "you," or "your") — and to individuals who use the service on a Customer's behalf (managers, cleaning staff, and other authorized users). By creating an account, accepting these Terms at sign-in, or otherwise using ResetProof, you agree to these Terms on behalf of yourself and, if applicable, the business you represent.

1. The Service

ResetProof is a business-to-business property verification platform. Managers photograph rooms to establish a reference standard ("reference photos"). Cleaning staff then re-photograph the same rooms through the app, and ResetProof uses artificial intelligence, processed through our own server-side infrastructure, to compare the two sets of photos and flag differences for manager review. ResetProof includes a mobile app (for managers and cleaning staff) and a web-based Manager Console (for reports, user management, and billing).

2. Eligibility

ResetProof is a business tool. It is not directed to, and may not be used by, individuals under the age of 18. By creating or using an account, you represent that (a) you are at least 18 years old, (b) you are using ResetProof on behalf of a business Customer that has agreed to these Terms, and (c) you are authorized to act on that Customer's behalf. We do not knowingly permit anyone under 18 to hold an account, regardless of role.

The Customer (the business entity that signs up) is responsible for verifying the eligibility and authorization of every individual it invites to the platform, including its own cleaning staff and managers.

3. Customer Representations

By using ResetProof, you represent and warrant that: (a) you have the full right, power, and authority to enter into these Terms and, where you act on behalf of a business, to bind that business; (b) you will comply with all applicable laws and regulations in your use of ResetProof; and (c) you have obtained all rights, consents, and permissions necessary for the photos and content submitted through your account, including any consent required for individuals who may be incidentally captured.

4. Account Registration

Customers create and manage accounts for their own staff through the Manager Console. Each individual user is responsible for maintaining the confidentiality of their own login credentials and must notify us at hello@resetproof.com if they suspect unauthorized access. The Customer is responsible for all activity that occurs under its organization's accounts, including promptly deactivating staff who leave or change roles, and for ensuring that everyone accessing ResetProof under its account complies with these Terms.

5. Acceptable Use

You agree to use ResetProof only for its intended purpose — property verification and cleaning quality management — and agree not to, and not to permit any third party to:

  • Use the service for any unlawful purpose or in violation of any applicable law, regulation, or order
  • Upload content that is fraudulent, misleading, or violates any third party's rights
  • Attempt to reverse engineer, copy, scrape, or replicate the ResetProof platform or its underlying AI workflows
  • Use the service to surveil, harass, or violate the privacy of any individual beyond what is reasonably necessary for property verification
  • Photograph people as the subject of a capture (ResetProof is designed to photograph rooms and property conditions, not individuals)
  • Transmit or introduce any virus, malware, or other harmful code
  • Attempt to gain unauthorized access to, or interfere with or disrupt the integrity, security, or performance of, the platform or any connected systems
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use any automated means (bots, scrapers, scripts) to access the platform or collect information from it
  • Use ResetProof for benchmarking or competitive analysis, or to build a competing product
  • Share account credentials with anyone other than the authorized user they were issued to
  • Attempt to circumvent subscription limits, metering, or billing controls

6. Photos and Content

Photos are captured directly through the ResetProof camera interface; the app does not support importing photos from a device's photo library. Photos are intended to document property interiors and conditions, not people. If a person is incidentally captured in the background of a photo (for example, a staff member briefly in frame), the Customer is responsible for ensuring this is consistent with its own workplace policies and applicable law, and for obtaining any consent required in its jurisdiction.

The Customer retains ownership of all photos and content uploaded through its account. By uploading content, the Customer grants PCB Creatives LLC a limited license to store, process, transmit (including to our AI and infrastructure providers, as described in the Privacy Policy), and display that content solely to provide the ResetProof service.

Managers may export photos and reports (as PDF reports or direct save-to-device) for the Customer's own recordkeeping. Exported photos retain their original capture-date metadata so they can serve as a dated record of property condition. Customers are responsible for how they store, share, and use exported material outside of ResetProof.

User responsibility for submitted content. All photos and content are submitted by users at their own initiative. The Customer is solely responsible for everything submitted through its account, including submissions by its staff, and represents that such content will not: be unlawful, obscene, or fraudulent; infringe or violate any third party's rights; or contain sensitive personal information, documents, or images of individuals that the Customer is not authorized to submit. ResetProof is intended solely for photographing property interiors and conditions; submitting anything else is a violation of these Terms.

No pre-screening. We do not review, monitor, or pre-screen submitted content before it is stored or processed, and we have no obligation to do so. Because our verification process is automated, content a user submits (including any non-property or sensitive content submitted in violation of these Terms) may be transmitted to our AI and infrastructure providers for processing. We are not responsible for evaluating, vetting, or determining the legality or appropriateness of submitted content, and we disclaim all liability arising from content submitted by users in violation of these Terms. The Customer's indemnification obligations apply to any such content.

Right to remove. We may, but are not obligated to, remove content or suspend any user or organization if we become aware of content or use that violates these Terms or applicable law.

7. Intellectual Property

ResetProof — including its software, mobile apps, Manager Console, workflows, designs, text, algorithms, know-how, and the "ResetProof" name and logo — is owned by PCB Creatives LLC (or its licensors) and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use ResetProof for your internal business purposes, and grant no ownership rights in the platform itself. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works of ResetProof except as expressly permitted.

Feedback. If you send us suggestions, feature requests, or other feedback, you grant PCB Creatives LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable right to use it to improve ResetProof or other products, without obligation or compensation to you.

Trademarks. The "ResetProof" name, logo, and related marks are the exclusive property of PCB Creatives LLC. You may not use or imitate them without our prior written consent.

8. Subscription and Billing

ResetProof subscriptions are purchased and managed exclusively through the web-based Manager Console via our payment processor, Stripe. Subscriptions are not available for purchase within the mobile app.

  • Plans are priced per active listing, on a subscription basis, and may include metered usage for AI-based photo comparisons beyond a plan's included allowance
  • Subscriptions are billed in advance on a recurring basis at the rate applicable to the Customer's selected plan
  • The Customer may cancel at any time through the Manager Console; cancellation takes effect at the end of the current billing period
  • We reserve the right to modify pricing with at least 30 days' advance notice
  • At our sole discretion, we may provide complimentary ("comped") access, credits, or discounts to a Customer's account; these may be modified or revoked at any time
  • All fees are non-refundable except where required by law

9. Free Trials

We do not currently offer an automatic free trial. If we introduce a free trial in the future, its specific terms (duration, conversion to a paid plan, and any required notice) will be presented at signup and will govern in place of this section.

10. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability. We reserve the right to perform maintenance, updates, or modifications to the service at any time, and will make reasonable efforts to notify Customers of planned downtime that may affect their operations.

11. AI Verification

ResetProof uses AI to compare cleaning-staff photos against reference standards and to flag likely differences. AI results are an assistive tool, not a determination of fact. The AI can produce false flags (incorrectly identifying a problem) and can miss real issues. Final judgment about the condition of a room, and about whether it is ready for a guest, always rests with the Customer's human manager.

AI comparison output must not be used as the sole basis for any employment-related decision (including discipline, performance evaluation, or termination) regarding cleaning staff or any other individual. It is intended to support — not replace — human review and management judgment.

12. Data Retention and Deletion

Organization administrators control their organization's data through the Manager Console, including managing users and requesting deletion of content. When a Customer's organization account is deleted (whether by the Customer's request or account termination), we will remove the organization's photos, reports, and associated personal data from our active systems within a reasonable period, generally within 30 days. Residual copies may persist briefly in encrypted backups after that point and are purged in the ordinary course of our backup rotation.

13. Term and Termination

These Terms begin when you first access or use ResetProof and continue until terminated.

Termination by you. You may terminate at any time by contacting hello@resetproof.com or through the Manager Console. You remain responsible for any fees accrued before termination.

Termination or suspension by us. We may suspend or terminate an account or organization, effective on notice, if: (a) you materially breach these Terms and, where the breach is curable, do not cure it within ten (10) days of notice; (b) you fail to pay amounts due; (c) you use ResetProof unlawfully; (d) your use risks harm to us, the platform, or other users; or (e) we are required to do so by law. We may suspend access without prior notice where necessary to prevent harm or comply with a legal requirement.

Effect of termination. On termination, your license and right to use ResetProof cease immediately; accrued payment obligations survive; and, except as required by law or expressly stated here, no refund of prepaid fees is owed. Data handling on termination is governed by the Data Retention and Deletion section above.

14. Disclaimer of Warranties

ResetProof is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the service will be error-free, uninterrupted, secure, or free of defects or vulnerabilities, or that it will meet your requirements or achieve any particular result. ResetProof is a documentation and quality-control aid. It does not guarantee the cleanliness, safety, or habitability of any property, and use of ResetProof does not substitute for the Customer's own inspection, judgment, and compliance obligations. ResetProof processes user-submitted content automatically and makes no representation regarding the legality, accuracy, or appropriateness of any content submitted by users.

Data loss. While we take reasonable measures to operate and back up the service, we do not warrant that data will never be lost, corrupted, or become temporarily unavailable, including as a result of hardware failure, software error, or service interruption. Any backups we maintain are for our own operational and disaster-recovery purposes and are not a guaranteed data-retrieval service for Customers. The Customer is responsible for retaining its own copies of any photos, reports, or records it needs to keep — for example, by using ResetProof's export features — and should not rely on ResetProof as its sole system of record.

15. Limitation of Liability

To the maximum extent permitted by applicable law, PCB Creatives LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, however caused, including loss of profits, revenue, or business opportunities; loss of data, use, or goodwill; business interruption; or the cost of substitute services — including damages arising from reliance on AI verification results, guest complaints, property damage, data loss, or personnel decisions made using ResetProof output.

Our total and aggregate liability arising out of or related to these Terms or ResetProof, under any theory, shall not exceed the amount the Customer paid us in the three (3) months immediately preceding the event giving rise to the liability. The existence of more than one claim shall not enlarge this limit.

Exceptions. These limitations do not apply to: (a) your obligation to pay fees owed; (b) your indemnification obligations; (c) liability arising from a party's gross negligence or willful misconduct; or (d) any liability that cannot be limited or excluded under applicable law.

Acknowledgement. You acknowledge that our pricing reflects the allocation of risk in these Terms, that we would not provide ResetProof without these limitations, and that these limitations are a fundamental basis of the agreement between us.

16. Indemnification

You agree to defend, indemnify, and hold harmless PCB Creatives LLC and its officers, employees, and agents from any third-party claims, and related losses, damages, and reasonable costs and attorneys' fees, arising out of or relating to: your use of ResetProof in violation of these Terms; your breach of any representation, warranty, or obligation here; your violation of any law or third-party right, including the rights of individuals incidentally captured in photos taken under your account; or any property you own, control, or manage in connection with ResetProof.

Procedure. Our indemnification rights are conditioned on us: (a) promptly notifying you of the claim (late notice excuses you only to the extent it prejudices your defense); (b) giving you control of the defense and settlement, provided no settlement may admit fault by us, impose any obligation on us, or require us to stop operating ResetProof without our written consent; and (c) reasonably cooperating at your expense. We may participate with our own counsel at our own expense.

17. Dispute Resolution and Arbitration

Please read this section carefully — it affects how disputes are resolved and limits how you can bring claims.

Informal resolution first. Before starting arbitration, the parties agree to try to resolve any dispute informally for at least thirty (30) days after written notice of the dispute is sent to the other party (to us, at hello@resetproof.com).

Binding arbitration. If the dispute is not resolved, any dispute arising out of or relating to these Terms or ResetProof will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, rather than in court, except that either party may bring qualifying claims in small-claims court and either party may seek temporary injunctive relief in court to prevent irreparable harm pending arbitration. The Federal Arbitration Act governs this section. Arbitration may be conducted virtually or in the state where the Customer is located.

Class-action waiver. Disputes will be brought only in an individual capacity. To the fullest extent permitted by law, no dispute will be brought or arbitrated as a class, collective, or representative action, and the arbitrator has no authority to hear one.

Exclusion. Consistent with applicable federal law, this section does not require arbitration of claims of sexual assault or sexual harassment, which you may bring in court.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Subject to the arbitration section above, any disputes that proceed in court shall be resolved in the state or federal courts located in California.

19. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will update the "Last Updated" date at the top of this page and notify active Customers by email. Continued use of ResetProof after updated Terms are posted constitutes acceptance of the revised Terms.

20. General Provisions

Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the rest remains in full force.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them, including in connection with a merger, acquisition, or sale of assets. These Terms bind the parties and their permitted successors and assigns.

Entire agreement. These Terms are the entire agreement between you and us regarding ResetProof and supersede any prior agreements on the subject.

Waiver. Our failure to enforce any provision is not a waiver of it or of the right to enforce it later.

No third-party beneficiaries. These Terms are for the benefit of the parties only and create no rights in any other person.

Electronic communications and signatures. You consent to receive communications from us electronically (email or in-app notices), and agree that electronic acceptance of these Terms has the same effect as a written signature.

Force majeure. Neither party is liable for any delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, including acts of God, natural disasters, outages of telecommunications or utility services, or failures of third-party infrastructure providers.

Survival. Provisions that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution and Arbitration, Governing Law, and these General Provisions — survive termination or expiration of these Terms.
